We are Dukes Education Ltd ( Trading as Dukes Medical Applications), a company registered in England under number 3757054. Our registered office is at 14-16 Waterloo Place, London SW1Y 4AR. Dukes Education Ltd is registered with the ICO as entry Z6117995. Please read these terms carefully before using this website. These terms apply to all use of this website and Dukes Education Services. By using this website or purchasing our services you agree that you have read and accept these terms. You may as part of your use copy electronically and print portions of the website but you should not use such access or content to generate income of any kind. Any other use of materials on this website (including without limitation reproduction for a purpose other than that noted above and any modification, distribution or republication) without our prior written permission is prohibited. In particular, you may not use any data, research or information made available on or by this website in connection with any business or commercial undertaking (whether or not for profit).The intellectual property in all design, text, graphics and other material and the selection or arrangement of such material in this website is owned by us and/or our respective licensors. We do not make any representations, warranties or terms of any kind in respect of this website or its contents (including, without limitation, any views or comment made) other than those required by law. Our Rules

These Rules (including our Privacy Policy) govern the use of www.staging.dukesmedicalapplications.com and set out the terms of the contract between Dukes Education Ltd (“us/we”) and each User. A User can apply to register with Dukes Medical Applications by filling out the registration form and submitting it online. Each User can then use Dukes Medical Applications to find useful information about applying to Medical Schools. If you apply to register with Dukes Medical Applications you accept these rules. Our Privacy Policy (which is part of these Rules) sets out the information that we will collect about you and how your information will be used and who it may be shared with. We will comply with our Privacy Policy – every user of this site should read it carefully. If a User thinks an unauthorised person has become aware of any User password, they should contact Dukes Education immediately. We cannot be responsible for any unauthorised activity on www.dukesmedicalapplications.com. We may remove any Registered User from the www.dukesmedicalapplications.com at any time and for any reason. We may also, on notifying the Registered User, immediately suspend or terminate the rights of any Registered User, if they breach these Rules, if we reasonably believe that they have acted in a manner not permitted by these Rules, if there is any theft from or misconduct in connection with us, if they supply false or misleading information to us or if they are abusive or offensive to any member of our staff or other Registered User. A Registered User can close his/her Dukes Medical Applications Usership at any time by notifying us. If a Registered User’s membership is closed his/her rights to access any aspect of Dukes Medical Applications services are lost. We may make changes to these Rules and will give the Registered User as much notice as we reasonably can. We may suspend or terminate Dukes Education Ltd but will give as much notice as we reasonably can before we do so. If this happens all Registered Userships will be suspended or terminated. Dukes Education tries to keep www.dukesmedicalapplications.com safe for all members. It is the prudent thing to do to make sure you know some examples of what keeping the website safe really means: You will not send or otherwise post unauthorised commercial communications (such as spam) on www.dukesmedicalapplications.com.You will not upload viruses or other malicious code. You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence. You will not offer any contest, giveaway, or sweepstakes (“promotion”) on www.dukesmedicalapplications.com without our prior written consent. You will not use www.dukesmedicalapplications.com to do anything unlawful, misleading, malicious, or discriminatory. You will not do anything that could disable, overburden, or impair the proper working of www.dukesmedicalapplications.com, such as a denial of service attack. You will not facilitate or encourage any violations of these Rules. Our only responsibilities with respect to Dukes Education are set out in these Rules which are subject to English law. These Rules shall not exclude or limit our liability for death or personal injury caused by our negligence. These Rules prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. You can contact us by logging onto our website or by calling the Dukes Education offices or writing to us at Dukes Education’s registered office address. We may record calls to check the quality of our services or for training, audit or security purposes.

Dukes Medical Applications Privacy Policy

Courses and Events

Students attending any of our events or courses agree to comply with our health and safety rules and our course rules (as listed below).

Course Rules

The breach of any course rule stated below may result in dismissal from the course. Furthermore, any student who breaks the law or displays aggressive, intimidating or racist behaviour will face instant dismissal from the course. Should a student face instant dismissal, the student will be withdrawn from the course with immediate effect. No refund will be made on the course fee. a) Students are expected to attend all classes provided on time unless agreed in advance with a member of Dukes Medical Applications staff. Should a student wish to leave the course or event early, a parent or guardian must give their consent for this. a) All damage to property, equipment and rooms will be charged to the student. b) Gratuitous or wilful damage, theft or suspected theft of Dukes Education property, public property or other students’ property may result in dismissal from the course. c) Consumption or possession of alcohol by students of any age is not permitted and will result in dismissal from the course. d) Drug-taking or possession of drugs including Psychoactive Substances (in the UK formally known as legal highs) will result in instant dismissal from the course. e) Smoking is not permitted by any student under the age of 18. f) Racist or intimidating behaviour towards another student or member of staff will result in dismissal from the course. g) Personal mobile phones must be turned off during all lessons and scheduled activities unless otherwise instructed.

Preparation Weekend

Students attending any Preparation Weekend are additionally bound by the rules and policies of that course (as detailed in the confirmation email or available on request).

Our Refund & Cancellation Policy

Anyone who purchases a product or service from Dukes Education Ltd (“client”), either via the website, www.dukesmedicalapplications.com, email, telephone or in person, agrees to adhere to the following refund and cancellation policy.

The Premier Service

Please refer to separate terms and conditions, as outlined in the Premier Service contract that each client signs on initiation of the Premier Service programme.

Schools Programmes

Please refer to separate terms and conditions, as outlined in the Schools Programme contract that each client signs on initiation of the programme.

Private Consultations

If a client wishes to cancel a Private Consultation, the client must give Dukes Education at least 48-hours’ notice. If a client cancels within the 48-hour period, the full fee of the Private Consultation must be paid to Dukes Education Ltd.

Preparation Weekend

If a client wishes to cancel a place at any preparation course, the client must give Dukes Education at least 14 days’ notice. If a client cancels within the 14-day period, the full fee of the course must be paid to Dukes Education Ltd.

Young Person’s Medical Conference

Persons attending an event do so at their own risk and on the strict understanding that Dukes Education Ltd does not accept liability for personal injury or damage unless directly caused by the proven negligence of the company or its servants. If a client wishes to cancel a place at an Young Person’s Medical Conference, the client must give Dukes Education at least 72 hours’ notice of the booked event. Following the refund of a place, the repurchase of a place with a discount code will not be permitted. If a client cancels within the 72-hour notice period, the full package fee agreed at the time of booking of the Young Person’s Medical Conference must be paid to Dukes Education Ltd.

Interview Preparation Days

If a client wishes to cancel a place at an Interview Preparation Day, the client must give Dukes Education at least 72 hours’ notice of the booked event. Following the refund of a place, the repurchase of a place with a discount code will not be permitted. If a client cancels within the 72-hour notice period, the full package fee agreed at the time of booking of the Interview Preparation Day must be paid to Dukes Education Ltd.

Admissions Test Courses

If a client wishes to cancel a place at an Admissions Test Course, the client must give Dukes Education at least 72 hours’ notice of the booked event. If a client cancels within the 72-hour notice period, the full package fee agreed at the time of booking, of the Admissions Test Seminar must be paid to Dukes Education Ltd.

Private Tuition Session / Mock Interview Session

If a client wishes to cancel a booked Private Tuition Session / Mock Interview Session, the client must give Dukes Education at least 72 hours’ notice of the booked event. If a client cancels within the 72-hour notice period, the full package fee agreed at the time of booking, of the Private Tuition Session / Mock Interview Session place must be paid to Dukes Education Ltd

Mock Tests

On receipt of a PDF copy of one of our Mock Tests over email, our Mock Tests are non-refundable.

Course & College Reports

On receipt of a PDF copy of one of our Course and/or College Reports, the Reports are non-refundable.

Refunds

All refunds will be processed within 7 days of being received.

Disclaimer

Dukes Medical Applications is purely an advisory service. The information and preparation we offer should be taken in that context. We cannot guarantee an applicant a place at any university. As such, Dukes Education Ltd. is not liable for any applicant’s unsuccessful application. Although we strive to ensure the accuracy of our information, we cannot guarantee it and Dukes Medical Applications accepts no liability whatsoever if the information it provides proves to be incorrect or if an applicant acts differently to how he or she would have acted without the services of Dukes Medical Applications. Dukes Education Ltd. respect your privacy and are committed to protecting your personal data. This privacy policy will inform you as to how we look after your personal data when you visit our websites (regardless of where you visit them from) and tell you about your privacy rights and how the law protects you.

What does this policy cover?

This policy describes how Dukes Education Ltd. and other companies in the Dukes Education Group will make use of your personal data when you register your details or your child’s details on any one of the Dukes Education Group websites, so when we mention “Controller”, “we”, “us” or “our” in this privacy policy, we are referring to the relevant company in the Dukes Education Group responsible for processing your personal data.

It also describes your data protection rights, including a right to object to some of the processing which a member of the Dukes Education Group carries out. More information about your rights, and how to exercise them, is set out in the “What rights do I have?” section.

What information do we collect?

We collect and process personal data about you when you interact with us and our websites, and when you purchase resources and/or services from us. This includes:

  •  your name, your child’s name, username and password;
  •  your / your child’s gender;
  • your age/date of birth and / or your child’s age/date of birth together with any relevant medical information required for us to perform a service (only where necessary);
  • your home address, email address and phone number;
  • your payment and delivery details, including billing address and credit card details, where you make purchases from us (where relevant);
  • your marketing preferences, including any consents you have given us;
  • communications that you may send to us;
  • information related to the browser or device you use to access our website.

How do we use this information, and what is the legal basis for this use?

  • We process this personal data for the following purposes:
    To fulfil a contract, or take steps linked to a contract: this is relevant where you purchase resources or services from us. This includes:
    o verifying your identity;
    o taking payments;
    o communicating with you;
    o providing customer services and arranging the delivery or other provision of resources or services.
  • As required to conduct our business and pursue our legitimate interests, in particular:
    o we will use your information to provide details of resources and services you have enquired about or resources or services you have requested, and respond to any comments or complaints you may send us;
    o we monitor use of our websites and online services, and use your information to help us monitor, improve and protect our resources, content, services and websites, both online and offline;
    o we use information you provide to personalise our website, resources or services for you;
    o where relevant, if you provide a credit or debit card as payment, we also use third parties to check the validity of the sort code, account number and card number you submit in order to prevent fraud (see data sharing below);
    o we monitor customer accounts to prevent, investigate and/or report fraud, terrorism, misrepresentation, security incidents or crime, in accordance with applicable law;
    o we use information you provide to investigate any complaints received from you or from others, about our website or our resources or services;
    o we will use personal data in connection with legal claims, compliance, regulatory and investigative purposes as necessary (including disclosure of such information in connection with legal process or litigation), for example we may need to share personal data with the Department of Education or an inspection authority to comply with our regulatory obligations;
    o we use personal data of some individuals to invite them to take part in market research.
  • Where you give us consent:
    o we will send you direct marketing in relation to our relevant resources and services, or other resources and services provided by us.;
    o we place cookies and use similar technologies in accordance with our cookies policy (see below paragraph Cookies and how we use them) and the information provided to you when those technologies are used;
    o on other occasions where we ask you for consent, we will use the personal data for the purpose which we explain at that time.
  • For purposes which are required by law:
    o where we need parental consent to provide online services to children under 13. However, most of our websites are not designed for children under 16;
    o in response to requests by government or law enforcement authorities conducting an investigation.

Relying on our legitimate interests

We have carried out balancing tests for all the data processing we carry out on the basis of our legitimate interests, which we have described above. You can obtain information on any of our balancing tests by contacting us using the details set out later in this notice.

Withdrawing consent or otherwise objecting to direct marketing

Wherever we rely on your consent, you will always be able to withdraw that consent, although we may have other legal grounds for processing your personal data for other purposes, such as those set out above. In some cases, we are able to send you direct marketing without your consent, where we rely on our legitimate interests. You have an absolute right to opt-out of direct marketing, at any time. You can do this by following the instructions in the communication where this is an electronic message, updating your preferences in any account or by contacting us using the details set out below.

Who will we share this personal data with, where and when?

We will share your personal data within the Dukes Education Group for reporting, safeguarding, quality control and potential referral basis (for example, to our consultancy division in respect of university applications). Personal data will also be shared with other organisations, such as insurers and organisations which conduct background checks, where necessary.

Personal data may be shared with government authorities and/or law enforcement officials if required for the purposes above, if mandated by law or if required for the legal protection of our legitimate interests in compliance with applicable laws.

Personal data will also be shared with third party service providers, who will process it on behalf of a Controller for the purposes identified above. In particular, we use third party providers of website hosting, maintenance and identity checking.

In the event that the business is sold or integrated with another business, your details will be disclosed to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business.

Cookies and how we use them

Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site.

We use traffic log cookies to identify which pages are being used. This helps us analyse data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

In addition, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the personal data to meet a contractual or other legal requirement, or where we are using the personal data for direct marketing).
These rights may be limited, for example if fulfilling your request would reveal personal data about another person, where they would infringe the rights of a third party (including our rights) or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping. Relevant exemptions are included in both the GDPR and in the Data Protection Act 2018. We will inform you of relevant exemptions we rely upon when responding to any request you make.To exercise any of these rights, or to obtain other information, such as a copy of a legitimate interests balancing test, you can get in touch with us via our Data Protection Champion using the details set out below. If you have unresolved concerns, you have the right to complain to an EU data protection authority where you live, work or where you believe a breach may have occurred. This likely to be the Information Commissioner’s Office in the UK.

How long will your retain my personal data?

We only retain your personal data for as long as is required by law, or for as long as necessary for the purposes for which we process your personal data. Please refer to our Data Retention Policy available from our website for further information.
